Terms of Service

Welcome to Nect! These Terms of Service ("Terms") govern your use of the Nect mobile application ("App") developed by Jacob Walker, doing business as WalkerTech ("we," "us," or "our"). By accessing or using Nect, you agree to be bound by these Terms.

Important: Please read these Terms carefully before using the App. If you do not agree to these Terms, you may not use Nect.

1. Acceptance of Terms

By creating an account, accessing, or using Nect, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and WalkerTech.

2. Eligibility and Age Requirement

2.1 Minimum Age

You must be at least 13 years of age to create an account and use Nect. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

2.2 Account Accuracy

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3. User Accounts

3.1 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use of your account

3.2 Account Termination

You may delete your account at any time through the App's settings. Upon deletion, your account and associated data will be permanently removed from our systems.

4. Acceptable Use Policy

4.1 Permitted Uses

You may use Nect to:

Share posts, photos, and videos
Discover and save places
Create and manage vacation plans
Interact with other users through comments and likes
Follow other users and view their public content

4.2 Prohibited Content and Conduct

You agree NOT to post, upload, or share content that:

Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of another's privacy
Contains nudity, pornography, or sexually explicit material
Depicts or promotes violence, gore, or self-harm
Promotes hate speech, discrimination, or bigotry based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
Infringes on intellectual property rights, including copyrights, trademarks, or patents
Contains spam, advertisements, or promotional material not authorized by us
Impersonates another person or entity
Contains viruses, malware, or other harmful code
Violates any local, state, national, or international law

Zero-Tolerance Policy: We have zero tolerance for abusive, offensive, or objectionable content. Content that violates these rules may be removed immediately, and users who post such content may have their accounts suspended or terminated.

Reporting and Enforcement: Users can report content that violates these Terms using the in-app reporting system. All reported content will be reviewed within 24 hours, and appropriate action, including removal of content and suspension of offending users, will be taken.

4.3 Additional Prohibited Activities

You agree NOT to:

Use the App for any commercial purpose without our written permission
Scrape, data mine, or use automated systems to access the App
Attempt to gain unauthorized access to the App or other users' accounts
Interfere with or disrupt the App's functionality or servers
Create multiple accounts or fake accounts
Harass, bully, stalk, or threaten other users
Encourage or facilitate violations of these Terms

5. Content Ownership and License

5.1 Your Content Ownership

You retain all ownership rights to the content you post on Nect, including posts, photos, videos, comments, and other materials ("User Content").

5.2 License Grant to WalkerTech

By posting User Content on Nect, you grant WalkerTech a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:

Use, reproduce, modify, adapt, and publish your User Content
Display and distribute your User Content within the App and on our marketing materials
Create derivative works based on your User Content
Use your User Content for promotional purposes

This license continues even if you stop using the App, but terminates when you delete your content or account (except for content shared or reposted by other users).

5.3 Our Content

All content provided by Nect, including but not limited to text, graphics, logos, software, and functionality, is owned by WalkerTech and protected by copyright, trademark, and other intellectual property laws.

6. Content Moderation

6.1 Review Process

We manually review reported content and reserve the right to remove any content that violates these Terms without prior notice.

6.2 Reporting System

Users can report content that violates these Terms using the in-app reporting system. All reported content will be reviewed within 24 hours, and appropriate action, including removal of content and suspension of offending users, will be taken.

6.3 No Obligation to Monitor

While we moderate content, we are not obligated to monitor all User Content and are not responsible for content posted by users.

6.4 Blocking Users

You may block other users to prevent them from viewing your content or interacting with you. Blocked users will not be able to comment, like, or message you.

7. Location Services

Nect uses your device's location to:

Recommend nearby places
Enhance your user experience
Provide location-based features

You can disable location services at any time through your device settings, though this may limit certain features of the App.

8. Third-Party Services

8.1 Advertisements

Nect displays advertisements through Google AdMob. Your interaction with advertisements is governed by Google's privacy policies and terms of service.

8.2 External Services

The App uses the following third-party services:

Firebase (data storage and authentication)
Google Places API (location and place information)
Google AdMob (advertisements)

Your use of these services is subject to their respective terms and privacy policies.

8.3 Third-Party Links

Nect may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party sites.

9. Premium Features and In-App Purchases

9.1 Future Offerings

We may offer subscription plans and in-app purchases in the future. When available, these will be subject to additional terms and pricing information provided at the time of purchase.

9.2 Payments

All purchases are processed through the Apple App Store. Refunds and payment disputes are subject to Apple's policies.

10. Account Suspension and Termination

10.1 Violations

We reserve the right to suspend or terminate your account if you:

Violate these Terms
Engage in prohibited conduct
Post prohibited content
Receive multiple content violations

10.2 Termination Process

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms.

10.3 Effect of Termination

Upon termination:

Your right to use the App will immediately cease
We may delete your account and User Content
You will not be entitled to any refund of fees paid (if applicable)

11. Privacy and Data Protection

Your use of Nect is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.

12. Disclaimers and Limitations of Liability

12.1 "As Is" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Uninterrupted or error-free operation

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WalkerTech SHALL NOT BE LIABLE FOR ANY:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Service interruptions or security breaches
User Content or conduct of other users
Unauthorized access to or alteration of your transmissions or data

12.3 User Responsibility

You are solely responsible for:

Your interactions with other users
The content you post
Any consequences arising from your use of the App

13. Indemnification

You agree to defend, indemnify, and hold harmless WalkerTech, Jacob Walker, and our affiliates from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

Your use of the App
Your violation of these Terms
Your User Content
Your violation of any rights of another person or entity

14. Changes to Terms

14.1 Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

Updating the "Last Updated" date at the top of these Terms
Posting a notice in the App
Sending an email notification (if applicable)

14.2 Acceptance of Changes

Your continued use of Nect after changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App and delete your account.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Florida, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of Nect shall be resolved through:

Good faith negotiation
Mediation (if negotiation fails)
Binding arbitration in accordance with the American Arbitration Association rules

15.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WalkerTech regarding the use of Nect and supersede all prior agreements and understandings.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

19. Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign these Terms without restriction.

20. Survival

Provisions that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
